Council of State ratified the suspension of the appointment of Jaime Garzón's sister as consul in Cancún

The court agreed with the arguments of the previous instance.

The Council of State ratified the suspension of the appointment of María Soledad Garzón Forerosister of the comedian and journalist Jaime Garzón, as consul of Colombia in Cancún (Mexico)

The decision confirmed the measure adopted by the Administrative Court of Cundinamarcawhich had provisionally suspended the effects of the act that made his appointment official.

According to the ruling of the Council of State, the suspension was maintained for the reasons stated by the Administrative Court of Cundinamarca in its ruling because at the time, the court argued that There were sufficient reasons to question the legality of the appointment.

Since mid-2023, the then chancellor, Álvaro Leyva, had announced that María Soledad Garzón She would be appointed in a provisional capacity as first secretary of foreign affairs, with a position at the global level of the Ministry of Foreign Affairs, assigned to the Consulate General of Colombia in Cancún.

This decision led to the filing of a lawsuit by stating that Jaime Garzón’s sister did not belong to the diplomatic career, since the plaintiffs affirm that at the time of appointment There were other officials in the running to fill that positionwhich gives them a preferential right to occupy the Colombian consul in Cancún (Mexico).

“It does not belong to the Diplomatic and Consular Career. At the time of his appointment there were career officials in the category of First Secretary of Foreign Affairs, “that they have a preferential right to occupy the position to which the defendant was appointed,” the lawsuit says.

These arguments were analyzed by the Administrative Court of Cundinamarca, which ruled in favor of the plaintiffs because they recognized the alleged fault in having named María Soledad Garzón above the officials who were in the running to aspire to be appointed to that position.

With this decision, the Council of State will return the process to the Administrative Court of Cundinamarca to continue with the study of the lawsuit and decide if Jaime Garzón’s sister should leave office permanently.
