Judge Raúl Justiniano decided to order 18 months of preventive detention against Rocío Leandro Melgar, alias comrade ‘Cusi’and another six investigated for the crime of affiliation to a terrorist organization, which, according to the investigations, operated from Ayacucho.
‘Cusi’ and company, according to the Public Ministry, are members of the “New Red Fraction”, a current of Shining Path that has had an active participation during the violent demonstrations against the government of Dina Boluarte in Ayacucho. Peru21 revealed a video where Leandro is seen delivering money to illegal miners to create chaos in Huamanga and other cities.
According to the Public Ministry, those investigated agitated the population through the front organization of Fredepa (Front for the Defense of the People of Ayacucho) in order to continue with the precepts of the Senderista group founded by the extinct genocidal Abimael Guzmán.
For Judge Justiniano, Rocío Leandro is the visible face of Fredepa. This -has been corroborated- is an organism generated from the new red faction of the terrorist organization Sendero Luminoso.
“All of them would be included in the crime of affiliation to a criminal organization, the most appropriate measure would be preventive detention based on the nature of the crime and the way in which it is committed,” said the judge.
And he added: “It is a crime where it is carried out by people acting clandestinely without being identified so that society or third parties can know the activity that they are really carrying out, in this case joining a terrorist organization.”
Likewise, he asserted that those investigated use or use terms of a criminal organization asking “that their leaders leave through this type of protest.” “In the case of the main leader, Abimael Guzmán, they have made a commemoration for the year of death of this man and have been photographed on September 8 and September 11, the day of the death of the aforementioned leader, placing a banner regarding this person, for this reason there is no less burdensome measure for these investigated than the preventive detention measure, ”he said.
