The case
The cause began after the current mayoress of Vitacura, Camila Merino (Evópoli), detected last year irregularities in municipal development programs (Vita programs) during the Torrealba administration.
The municipality filed a complaint in July 2021 for the crimes of embezzlement of public funds, falsification of a private instrument, fraud and illegal exactions in the functional organizations that manage the Vita programs.
Along these lines, the building house filed a complaint in August 2021 against those who were responsible for alleged diversion of public funds to the personal accounts of Torrealba and other former officials.
Subsequently, the municipality filed a complaint in December 2022 against Torrealba, his ex-circle of trust and other people, for the crimes of tax fraud and illicit association.
The lawyer representing the Municipality of Vitacura, Alexander Espinoza, indicated at the time that “we believe that beyond the commission of specific crimes, an organization with command, hierarchy and permanence over time operated here. That is why we believe that there are elements here to impute the crime of illicit association.
Regarding the role of Torrealba, Espinoza pointed out that “he was at the head of this organization”, where the Prosecutor’s Office investigates the diversion of funds from the “Vita” corporations, through the delivery of envelopes to the former community chief.
