The Plenum of the Special Electoral Jury of Arequipa declared unfounded the objection filed by the citizen Carlos Damián Manrique, against the registration of the candidate Rohel Sánchez Sánchez for the Regional Government of Arequipa.
The objection presented was based on the fact that the candidate did not meet the requirement of having a membership of at least six months, as established in the electoral regulations of your party and in which an illegal reduction has been made in the number of delegates, from 109 to finally 16, with which the terms of their call for internal elections have been violated, for which they concluded that all subsequent stages would be null.
The Plenum of the Special Electoral Jury determined that the only limitation established by law regarding the time of affiliation to apply is found in the Ninth Temporary Provision of Law No. 28094, Law of Political Organizations, which requires all candidates for governor the have affiliated no later than January 5, 2022. Political organizations are empowered to increase membership requirements among their candidates.
In the present case, the blemish fails to prove whether the party actually had an internal regulation in force that increases requirements among its candidates, since on November 30, 2021, Resolution No. 0928-2021-JNE was published, which approved the “Regulations for the internal election of candidates from regional movements that do not register electoral regulations for the process of regional and municipal elections 2022” .
This regulation entered into force the day after its publication. The registration of the electoral regulations of Yo Arequipa was only requested to the Registry of Political Organizations on December 17, 2021, so its internal election process was fully developed under the scope of the regulations of the National Elections Jury, which does not require greater seniority than that set by the Law of Political Organizations, with which, therefore, the infraction denounced in the crossout is ruled out.
On the other hand, regarding the reduction in the number of delegates carried out by Rohel Sánchez’s party, the JEE points out that it has been carried out within the time limit of the schedule for internal elections, which was approved by Resolution No. 0923-2021-JNE, in which the deadline for reporting delegates to ONPE was expressly set until March 26, 2022, deadline verified fulfilled.
