Santo Domingo The legal consultant of the Executive power, Antoliano Peraltapondered this Sunday what, the Constitutional Court found his decision to cancel it Read 1-24 about a procedural error during the legislative process of the norm, without questioning its content or identifying violations of fundamental rights.
He assured that, according to the «failedthe law was approved in both chambers with the necessary majorities, but without complying with the formalities required for its convocation and treatment as an organic law,” he explained.
Peralta reaffirmed that, the Executive power has a commitment to strengthening democratic institutions and the protection of interests of citizens in the field of national security.
In that sense, he argued that, in the sentencing procedure, the “Court concluded that the Congress did not expressly call the sessions as appropriate to deal with an organic law, although it obtained large majorities: 125 of 126 votes in the Chamber of Deputies and 21 of 25 in the Senate.

“This non-compliance vitiates the validity of the law, given that the organic rules require specific procedures according to the Constitution and legislative regulations,” he said.
He explained that the organic nature of Law 1-24 is linked to the scope of the national security and defensewhich gives it corganic character, but it did not regulate directly fundamental rights as some plaintiffs alleged.”
Regarding the formal observation, he stated that “the Constitutional Court stressed that nullity responds exclusively to aformal appearancesince the call rules for their treatment were not respected. This ruling emphasizes the need to follow procedures legislative with rigor.”
He Executive power respects and accepts the criteria of the Constitutional Courthighlighting its commitment to strict compliance with constitutional and legislative provisions.
“We salute the efforts of the Court in guaranteeing compliance with the legislative procedure in all its details, which strengthens our institutionality. He Government is committed to continue promoting initiatives that fully comply with the established legal framework,” said the legal consultant.
He stated that, although the sentence does not explicitly point them outthe mentioned irregularities can be corrected through the corresponding procedure in the National Congress.
Peralta remembered that, the Legislative Branch analyzes a proposal to reform Law no. 1-24, the result of consensus between the government and various actors in the civil society.
