According to the investigation, there was a first advance of S / 1,820,555 that was granted at the request of the company. In Accounting Expertise N ° 328/219 it is stated that the Consortium requested the advance “date before that indicated in the contract, in the bases and as indicated in the regulations of the State Procurement Law”.

Mera also noticed a second irregular payment, in the first advance for materials or input for a value of S / 2′002,403.

The regional government made the disbursement without considering that within this order the rental of machinery for an amount of S / 1,237,338 was contemplated, a fact that violates the signed contract.

“It is established that the rental services are not part of the materials or supplies that make up the costs, with the rental of machinery being a cost of manufacturing cargo that represents other costs of the construction industry,” indicates the expertise.

After this delivery, on August 17, 2011, the Road Consortium requested the second advance of materials for a value of S / 1′638,269, forming part of this request the coverage of machinery and equipment rental for S / 967,249.18.

Cerrón intervened

Prosecutor Mera showed that, after these payment advances, the regional government terminated the contract with the company.

The consequence of that decision was the call for an arbitration in which the Road Consortium, represented by Yuri Manrique Rivera, won and ordered the government of Vladimir Cerrón to pay 4 million 57 thousand 830 soles in favor of the company.

“It was the same man (Vladimir) Cerrón who decided to terminate the contract with the Road Consortium when the project did not exceed 40% of execution, thus generating damage to the State,” said the prosecutor in hearing.

For her part, the anticorruption attorney Nora Flores, who participated in the hearing, alleged that the granting of the advances in which the rental of machinery was included generated economic damage to the State.

“The officials have contravened the norms (…) a patrimonial damage to the State has been generated amounting to 2,400 thousand 587 soles and as extra-patrimonial damage 3 million 420 thousand soles,” Flores argued before the magistrate.

For these events, the Public Ministry asked the Judiciary for a sentence of four years and eight months in prison for the former regional authority and the same period of disqualification from holding public office. In addition, the Attorney General’s Office demands the payment of a civil compensation of 4 million 56 thousand 614 soles.

Luis Mayhua, Cerrón’s lawyer, said that his client did everything “according to the law.” The evidence is overwhelming, his fate seems cast.
