Anesthesiologist Giovanni Quintella Bezerra became a defendant for the crime of rape of a vulnerable woman against a woman who had just had a child, last Sunday (10), at the Hospital da Mulher Heloneida Studart, in São João de Meriti, in Baixada Fluminense.
The decision is by Judge Luís Gustavo Vasques, of the 2nd Criminal Court of São João de Meriti, of the Court of Justice of Rio de Janeiro (TJRJ), who received, on Friday (15), the complaint from the Public Ministry of Rio de Janeiro. Janeiro (MPRJ) against the doctor.
In the complaint, the prosecutors pointed out that “the crime was committed against a pregnant woman and in violation of the duty inherent to the profession”. The MP also asked for secrecy to be decreed in the process, to preserve and protect the victim’s image.
The process against the anesthesiologist began with the recording of the crime made by the nursing team that participated in the delivery, based on suspicion of the doctor’s behavior. With the images, the professionals communicated the fact to the head of the hospital, who called the Civil Police. The anesthesiologist, now a defendant, was arrested in the act and taken to the police station.
According to the magistrate, the complaint offered by the Public Prosecutor’s Office fulfills the legal requirements for its receipt. “In this regard, I emphasize that the complaint contains the exposition of the criminal facts, with all their circumstances, the qualification of the accused, the classification of the crime and the list of witnesses”, he wrote.
In the complaint, the prosecutors highlighted that Giovanni Quintella Bezerra acted freely and consciously. “With the desire to satisfy his lust, he practiced lewd acts other than carnal intercourse with the victim, the parturient unable to offer resistance due to the anesthetic sedation administered”, they pointed out.
The prosecutors also maintained that the accused “abuse of the relationship of trust that the victim had with him, since, taking advantage of the condition of an anesthesiologist, he took advantage of the authority/power he exercised over her, by applying substance to her with sedative”.
According to the TJRJ, the doctor, who had the arrest in the act converted into preventive by Judge Rachel Assad in the custody hearing held last Tuesday (12), will be summoned to present a defense within 10 days.
Since Tuesday Giovanni Quintella Bezerra has been imprisoned in the Pedrolino Werling de Oliveira Public Prison, Bangu 8, in the Gericinó Complex, in the west of Rio. The custodians with a higher level are taken to the place. As a safety measure, the anesthesiologist is isolated in a cell in gallery F of the unit. Upon arriving at the prison unit, the doctor was harassed by the other prisoners, beating the bars of the cells and cursing.
