The announcement was made at the Cultural Center of Banco do Brasil, where the government transition office of president-elect Luiz Inácio Lula da Silva operates. Haddad also appointed attorney Gustavo Caldas as deputy attorney general as of January 1st.

“Therefore, it will be in the hands of this duo to manage an issue of the utmost importance for the country’s fiscal balance. Few people give due importance to the need for a very fine performance by the PGFN in defending the National Treasury of the Union in the superior courts, STJ [Superior Tribunal de Justiça] and especially STF [Supremo Tribunal Federal]?? The victories we have achieved in recent weeks prove how important public advocacy is in the interest of the country’s fiscal sustainability,” said the future minister.

In the end from November, the role of the PGFN in the STF avoided a budgetary impact of approximately BRL 472 billion for the Union, in addition to a loss of revenue of BRL 100 billion per year. In the judgment, the STF defined the constitutionality of the non-cumulative contribution to PIS and Cofins.

According to Haddad, the new government will structure a group to monitor the country’s fiscal risk, with the PGFN, the Attorney General’s Office and the Ministry of Justice. “We are going to put together a team that to haveThere will be a firmer performance with the courts to reduce the fiscal risk of judicial decisions”, he explained.

In addition to defending the National Treasury from the courts, the PGFN also works to collect the Union’s overdue debt for means of transactions with debtors.

According to Anelize, there is a tax dispute, both administrative, within the scope of the Administrative Council of Tax Appeals (Carf), and judicial, which is relevant to the Federal Budget. “It is a discussion that is part of our democratic rule of law,” he said.

“And it is also true that there are means that taxpayers have the right and access to, which is this discussion. As the National Treasury, we work on this from the point of view of credit recovery, charging those who really owe, collecting the debt that is correct and investigating fraudsters and tax evaders”, he highlighted.

Anelize is the Monday woman to assume the PGFN, after Adriana Queiroz, who served in command of the body for six years, until 2015. “Minister Haddad has this perception that the more he invests in diversity and plurality, the more the ministry and society gain”, he said . “I am prepared to represent women, we have a female leadership agenda in the PGFN that I intend to continue investing in”, she added.

Anelize has been a prosecutor at the National Treasury since 2006. She has a master’s degree in public policy from the University of Oxford and a postgraduate degree in public administration from the Getulio Vergas Foundation. She served in the Subcommittee of Legal Affairs of the Presidency of the Republic, was chief prosecutor of the Active Debt in the 1st Region, chief of staff in the management of Adriana Queiroz and director of Active Debt Management of the Union, current Deputy Attorney General for Active Debt Management and the FGTS.
