AMLO presents initiatives to increase penalties for clandestine logging and production of synthetic drugs

President Andrés Manuel López Obrador sent the Union Congress two new reform initiatives to increase penalties for illegal felling of trees, as well as prevent and punish the illicit production of synthetic drugs.

The first presidential project seeks to reform and add articles 418, 419 and 423 of the Federal penal codeto prevent damage to environmentthe degradation of habitats and the loss of biodiversity that illegal logging generates through the implementation of penalties commensurate with the damage caused, as well as deterring illegal activities that both organized crime and illegal trade carry out in this sector .

He proposes that when dismantling or destroy natural vegetation; If one or more trees are cut, uprooted, felled or felled, or the use of forest land is changed, in a protected natural area, the current maximum penalty is increased from 12 to 13 years in prison and a fine from 4,000 to 8,000 times the daily value of the current Measurement and Update Unit.

Adds a penalty to whoever cuts, uproots, knocks down or fells one or more trees, when the conduct is carried out using firearms or any other violent means to obtain profit or economic benefit. Said conduct will be sanctioned with a penalty of three to 12 years in prison and a fine of 500 to 5,000 times the daily value of the current Measurement and Update Unit.

It specifies that no penalty will be applied to whoever cuts, uproots, knocks down or fells one or more trees, as well as whoever transports firewood or dead wood, as long as they carry out this activity exclusively for domestic use within their community.

The initiative sent to the Justice Commission of the Chamber of Deputies argues that in recent years, Mexico has recognized the importance of actively conserving and restoring forest ecosystems, given the weakness of the rule of law and inactivity in past governments that facilitated clandestine extraction and “laundering” of forest raw materials, mainly for commercial use.

They are going to carry penalties for drug production

President López Obrador also sent to San Lázaro an initiative that reforms, adds, and repeals various provisions of the Federal Law for the Control of Chemical Precursors, Essential Chemical Products, and Machines to Make Capsules, Tablets, and/or Tablets.

Specifically, it is proposed to strengthen control actions and more effective surveillance, control and verification measures of chemical precursors and essential chemical products, which ensure their correct availability for medical and scientific use.

And it intends to improve the control, registration and authorization of these activities regulated by law, to strengthen the performance of the agencies involved, through the Comprehensive System of Substances (If your). It was channeled to the Health Commission.

Likewise, it projects the strengthening of the control of the production, preparation, disposal, acquisition, import, export, transport, storage and distribution of chemical precursors, essential chemical products and machines to manufacture capsules, tablets or tablets, through the inter-institutional coordination of the Federal Government, the updating of administrative sanctions and the classification of crimes for behaviors related to the improper use of chemical precursors.

This, in order to contribute to the prevention, detection of diversion or use and punishment of the illicit production of synthetic drugs, to guarantee peace, security and health of Mexicans with unrestricted respect for human rights and good international practices in the matter.

Therefore, penalties ranging from 10 to 15 years in prison and fines equivalent to 10% of the income obtained are proposed against the person who diverts or makes use of chemical precursors for the production of synthetic drugs.

In addition to the same penalties for the person who falsifies or alters authorizations or permits for the import or export of chemical precursors.
