Otárola emphasized that the president omitted to communicate her temporary impediment, which could have constitutional implications, according to article 115 of the Constitution, which states that in cases of temporal or permanent impediment of the head of state, the president of the State must be informed.

He added that this response was also expressed by the president when he declared in the Public Ministry. He also stressed that the important thing is not the reason for the operation, but its legal and constitutional impact, since the president would have been absent from the position temporarily without communicating it to the President of the Congress. This would have violated article 115 of the Peruvian Constitution.
“Mrs. Boluarte had a temporary impediment at the time of submitting to the operation, she has recognized that herself. Consequently, she had to communicate it to Congress. That is the key issue that must be discussed,” Otárola warned.
Dina Boluarte would not have had face -to -face surgery meetings
During his speech before the Supervisory Commission, the Execrimer, Minister Alberto Otárola revealed that, between June 28 and July 10, 2023, he did not hold face -to -face meetings with President Dina Boluarte, despite being in functions as head of the Cabinet. As reported, there were only brief telephone communications in which the president justified her physical absence with an alleged severe flu, not to mention at any time that he was recovering from cosmetic surgery.
Otárola added that on July 5 Boluarte participated in a Council of Ministers, although without activating his camera, which prevented verifying his real condition. Only on July 10 he reappeared publicly in an official act together with the president of the Development Bank of Latin America, and two days later he presented himself to a new session of the Cabinet.
