The Ombudsman’s Office demanded this Thursday the maximum criminal sanction against Juan Antonio Enríquez García (48) who will serve preventive detention after being accused of kidnapping and sexually abusing a minor under 3 years of age, in the district of José Leonardo Ortiz, province of Chiclayo, Lambayeque region.
In a statement through his Twitter account, The institution indicated that it has been supervising the performance of the National Police, the Ministry of Women and Vulnerable Populations, the Public Ministry and the Judiciaryregarding the case of the minor named Damaris.
In addition, the Ombudsman’s Office stated that It is urgent that justice operators guarantee the rights of the girl to a comprehensive recovery of her physical and mental health; also provide special protection, access to justice. It must be ensured that the girl and her family receive psychological, social and legal assistance.
“We urge the authorities in charge of dealing with the case, the media and the population in general to guarantee and respect the right to privacy of the aggrieved girl. We remember that the dissemination of images of the case is prohibited because they re-victimize the girl”, he added.
According to the dissemination of images and videos, part of the police and tax investigation, appearing on social networksthe institution asked the Police Inspectorate and Internal Control of the Public Ministryan exhaustive investigation to find those responsible for leaking this material.
“We will continue to follow up on the provisions issued by the different justice operators; In addition, we will continue to accompany the family to guarantee that they have access to the services provided by the State”, he concluded.
In the same publication on the aforementioned social network, the National Police responded that “the police command has arranged for the Inspector General’s Office to carry out preliminary investigations regarding the dissemination of images and videos to which it refers, in order to establish the presumed responsibilities of police personnel, if applicable.”
Preventive prison
The Second Preparatory Investigation Court of José Leonardo Ortiz ordered nine months of preventive detention for Juan Antonio Enriquez Garciaaccused of the crimes of rape and aggravated kidnapping of a three-year-old girl.
The head of the aforementioned Court, María Vásquez Vásquez, ordered the measure in response to a request from the Public Ministry that accused Juan Antonio Enríquez of the aforementioned crimes.
The case
On Wednesday, the population of the José Leonardo Ortiz district and the city of Chiclayo reclaimed the maximum sanction against Enríquez García who was captured by the National Police. During the interrogation he admitted that he had kidnapped the minor and when asked about its whereabouts, he stated that he had it in block F, lot 19, of the Santuario urbanization, in Cercado de Chiclayo.
Upon arrival at the property, the little girl was found on the second floorapparently owned by the mother of the alleged kidnapper.
So, the Police entered to rescue the girl that was taken to pass the legal medical examination, in order to be evaluated and rule out the alleged commission of the crime against sexual freedom.
The discovery of the minor was achieved after 12 hours of intense search. She was kidnapped on Tuesday by a subject in the vicinity of her property located at the intersection of Leguía Avenue and Mexico Street, in the José Leonardo Ortiz district, in the province of Chiclayo.
The National Police set up Operation Fence, after the parents reported the incident to the Family Police Station, which immediately forwarded the proceedings to the Chiclayo Criminal Investigation Division (Divincri).
