The former head of the Ministry of Culture (Mincul) Giselle Ortiz referred to the order of the Inter-American Court of Human Rights (IA Court) to the Peruvian State not to implement the ruling of the constitutional Court (CT) about the annulment of the sentence against the pardon granted to former dictator Alberto Fujimoriwho is in prison inside a prison in Diroes, in Ate.
During an interview on RPP, the former minister pointed out that “there is a pardon commission, a medical board that evaluates, and an administrative process at the request of the family”, which can “determine if the person’s level of illness really is enough to grant a humanitarian pardon”. However, he pointed out that in the case of Alberto Fujimori, this did not happen that way.
“That did not happen in the pardon (to Alberto Fujimori) that was fixed at Christmas 2017 and that the TC considered valid. What we have said is that these are the legal mechanisms that exist and we are not going to oppose them as such. What we do not want is that they be violated to duly benefit from a pardon that does not correspond”, he stated.

In that sense, Giselle Ortiz pointed out that in case a medical board determines that Alberto Fujimori has a serious illness“will have to respect” an eventual pardon.
“The relatives do not act out of a level of hatred or resentment, neither towards Alberto Fujimori, nor towards the members of the Colina group. We have more than enough reasons to feel hate and anger, but it has not been the reason that has motivated us these 30 years, “she asserted.
Next, the former member of the Executive added: “In reality, we want that right to truth and justice to be guaranteed. That due process be guaranteed for the rights of the families of the victims that the State as a whole must provide. If that moment comes, we relatives will be respectful of what is determined and Fujimori will have to go home, and he will have to finish the days next to his family”.

Last Thursday, April 7, The Inter-American Court indicated that the State of Peru must abstain “to implement the sentence passed by the constitutional Court on March 1, 2022, which restores the effects of the pardon ‘for humanitarian reasons’ granted to Alberto Fujimori Fujimori on December 24, 2017″.
The international body considered that the pardon granted to Alberto Fujimori “did not comply with the conditions determined in the decision to supervise compliance with the judgment of May 30, 2018″.
Similarly, the Inter-American Court urged the Peruvian State to present, no later than May 13, 2022, a report on compliance with the obligation to investigate, prosecute and punish in relation to not to execute the sentence issued by the TC last March 17which restores the effects of the pardon to fujimori.
