Deputies: a round of consultations begins to modify the Rental Law

After listening to specialists and tenants, the deputies will debate the modifications to the law.

The General Legislation Commission of the Chamber of Deputies will begin on Tuesday the treatment of the projects that seek to modify the Rental Law, with a round of consultations with specialists and those interested in the matter, in pursuit of the goal of being able to issue an opinion before the end of the month.

According to the schedule agreed last week, the commission will carry out this Tuesday, between 1:00 p.m. and 5:00 p.m. and virtually, the first of the three meetings that were initially established to listen to associations of tenants, owners and real estate, among others.

The agenda will continue the following week with face-to-face meetings on Tuesday 19 and Wednesday 20; and would end with internal debate between the deputieswhich would take place on Tuesday 26 and Wednesday 27, the date on which it is intended to issue an opinion.

The commission chaired by the ruling party Cecilia Moreau would thus meet the deadline that the Chamber imposed on itself ten days ago, when the authorities of the body and the main blocs agreed that the debate should be exhausted in 30 business days counted from April 5, that is, before May 18.

The main political spaces agreed to address the issue after Together for Change decided to lift the request for a special session to deal with it -on Tuesday the 5th-, in a plenary in which, a priori, the ruling party would not give a quorum and JxC would not reach that objective nor the special majority to debate the project without the corresponding opinion.

On the agenda of that special session request, Together for Change had requested the plain and simple repeal of the Rental Law approved in 2020; a norm that had the support of the majority of the blocks, and that in recent times since most of the forces coincided in pointing out that “it failed”.

Nevertheless, the total repeal is resisted transversally by the bulk of the members of the main political spaceswho consider that the text approved in June 2020 contributed important issues such as the expansion of the range of instruments allowed to support the operation, since surety insurance, bank guarantees and surety bonds were added to the guarantee through real estate deeds .

It will also preserve The tenant pays one month in advance and one month as a deposit. since before he paid at least two months of deposit; and the text would be maintained in relation to the clarifications on who pays the extraordinary expenses and who pays the common expenses.

According to journalistic and social media opinions issued by several deputies from different sectors, the greatest coincidence is around the need to move forward with the repeal of the two most questioned articles less than two years after their sanction and a year of its implementation.

One of the most disputed questions is the terms of the contracts, which were extended to a minimum of three years, instead of the two that previously governed; and the other was the implementation of the income updating methodologybased on an average between the Consumer Price Index and the average salary, with an annual adjustment interval.

At the extremes of the majority coincidences that would lead to a consensus opinion with the elimination of these two articles, there are antagonistic positions expressed in recent days by smaller groups of deputies, and even embodied in bills.

These are those of those who seek to eliminate all legislation to “let the market regulate”, as expressed by libertarians and some PRO legislators; or those of those who propose, independently, to create a body that sets reference prices or taxes idle housing, such as the case of some deputies from the Front of All or the Left.

In the commission, the Frente de Todos has a majority, since it has 16 of the 31 members, while Together for Change has 14 and one from the Federal interblock; although the sources consulted suggest that a consensual project will be reached and that the vote will be cross-cutting with the political parties or coalitions.

In addition to Moreau, the official members of the General Legislation Commission are Paula Penacca, Vanesa Siley, Constanza Alonso, Daniel Arroyo, Lia Marín, Mónica Litza and Carolina Gaillard, among others.

For Together for Change are Carla Carrizo, Karina Banfi, Margarita Stolbizer, Pablo Tonelli, Omar de Marchi, María Eugenia Vidal and Maximiliano Ferraro, among others.

The remaining member is Graciela Camaño, from the Identidad Bonaerense block.
