The Buenos Aires national deputy of the Frente de Todos (FdT) Gisela Marziotta presented a project to modify the real estate rental regime for housing, which seeks the suspension of increases until the new law comes into force and which proposes to create the National Chamber of Rentals.

The project establishes suspension of rent increases until the new law takes effectfrom which changes in prices will be regulated by the National Chamber of Rentals (CNA), autonomous body created by the rule.

In addition, the project establishes that “it will be prohibited, in the event that the rent is for housing, that the tenant request the payment of rents in advance for periods greater than one month and that security deposits are higher than the monthly rental value.

“Access to housing is a human right that has to be guaranteed by the State,” Marziotta pointed out, explaining that the right of access to housing is guaranteed in article 14 bis of the Constitution, that commits the State not only to ensure a house to all the inhabitants of the country but that it be worthy.

Among other central aspects of the project, it stands out that deposits may be paid in six equal installments from the date of signing the contractand that at the time of renewing the lease, in the event that the landlord does not respond to the tenant’s renewal request, the contract will be automatically renewed for the previous term, as reported in a statement.

The CNA will be the key body in the regulation of rental prices and control of contracts, and will be made up of two representatives of the Executive Power -one from the Ministry of Territorial Development and Habitat and another from the Secretary of Commerce-, a representative of the tenants and another of the landlords, who must belong to associations that represent both sectors.

This composition must also have gender parity and will meet at least monthly.

“The law that we sanctioned in the pandemic was a great advance, which is why it was resisted and boycotted by the main players in the market. But we cannot ignore the fact that, with the pandemic context, to which is added a rising dollar and a year-on-year inflation that exceeds 50%, dollarized real estate and salaries that are not recovered, a greater presence of the State is necessary,” added the deputy.
