Active employment policies (part III)

Complementing our two previous articles on “Active Employment Policies” – Parts I and II, we will comment this time on Decree 308/021 that regulates the subsidies and conditions stipulated for each of the modalities promoted in Law 19,973.

BENEFITS ACCORDING TO THE MODALITIES:

  • Temporary subsidy for hiring unemployed youth

When young women or young people with dependents are hired, the subsidy will be 40% of the monthly salaries of the worker that constitute taxable matter for CESS with a maximum amount of the subsidy of $ 9,000. If the working day is less than the full legal day, the ceiling of the subsidy will be $ 4,500.

In other cases, the subsidy will be 30% of the worker’s monthly salaries that constitute taxable matter for CESS with a maximum amount of the subsidy of $ 7,000. If the working day is less than the full legal day, the ceiling of the subsidy will be $ 3,500.

  • First work experience contracts

Companies that hire male workers under this modality will receive a subsidy of $ 6,000 per month and in the case of female workers it amounts to $ 7,500 per month. Said amounts will be applied to full-time hiring. If the working day is less than the maximum hourly load, the subsidy will be $ 3,000 in the case of male workers and $ 3,750 in the case of female workers.

  • Labor practice for graduates

No modifications. The subsidy is the one reported in Law 19,973.

  • Sheltered youth work

The beneficiaries are people between 15 and 29 years old. The employer that hires young male workers under this modality will obtain a subsidy of 40% of the monthly salary of the worker that constitutes taxable matter for CESS. The subsidy is 60% of the salary in the case of young female workers.

Article 36 establishes that: “Young protected work will also be considered that carried out within the framework of programs that present any of the following components:

a) Social support of the beneficiary that also includes the educational supervision of the tasks to be carried out.

b) Subsidies to participating companies.

c) Training for the beneficiary. “

It should be taken into account that the programs can combine training activities in the classroom with work activities to be carried out in companies simultaneously or alternately.

In the case of hiring carried out through the programs established in article 36, the subsidy will be 60% of the monthly salary of the worker that constitutes taxable matter for CESS, in the case of young male workers, and 80% of the remuneration in the case of young female workers. The maximum amount of the subsidy in these cases will be 80% of 2 National Minimum Wages.

The subsidy will be up to 50% on the remuneration of the contracted personnel. The remuneration is 75% of the minimum salary of the respective category. The granting of the subsidy and the percentage will be defined by the National Employment Directorate of the MTSS.

  • Benefit for hiring unemployed workers over 45 years of age

When unemployed people over 45 are hired, the subsidy will be equivalent to $ 7,000 in the case of male workers, $ 8,000 per month in the case of female workers and $ 9,000 if the worker had dependents.

Said amounts will be applied in a full legal working day regime. If the working day is less than the maximum hourly load, the subsidy will be $ 3,500 in the case of hiring male workers, $ 4,000 in the case of hiring female workers and $ 4,500 if the worker had minor or elderly people with disabilities in his charge .

  • Protected work for over 45s

People over 45 years of age who meet the conditions set forth in the sheltered work program may be hired under this modality and will have the same benefits as “sheltered work for young people”.

  • Benefit for hiring unemployed disabled workers

When the employer hires people with disabilities who are unemployed, the subsidy will be equivalent to $ 7,000 in the case of male workers, $ 8,000 per month in the case of female workers and $ 9,000 if the worker had dependents.

Said amounts will be applied in a full legal working day regime. If the working day is less than the maximum hourly load, the subsidy will be $ 3,500 in the case of hiring male workers, $ 4,000 in the case of hiring female workers and $ 4,500 if the worker had minor or elderly people with disabilities in his charge .

Employers with 25 or more workers who do not have the compliance certificate issued by the National Commission for Labor Inclusion for not meeting the required quota, may hire people under this modality, but they will not be able to receive the payment of the subsidy until it is fulfilled. with the required fee. If the requirement is met within the first 3 months from hiring, the subsidy will be awarded retroactively. After the term, the subsidy will be received from the moment the certificate is obtained until the contracting period expires.

In conclusion, Law 19.973 and Decree 308/021 strongly promote active employment policies that are being carried out by the Ministry of Labor and Social Security in conjunction with the Executive Power.

These policies are aimed at the labor inclusion of sectors with greater vulnerability, granting benefits to employers in return.
