The governor of Arequipa, Elmer Cáceres Llica, will remain in the hands of the authorities and will have to serve 10 days of preliminary detention ordered, in the first instance, by a Preparatory Investigation court due to allegedly leading the criminal organization The Children of the Condor, through which he gave gifts to officials and regional authorities in exchange for favoring him in his decisions and legislative proposals, among other acts.
The Second Criminal Appeals Chamber analyzed the request of the defense of Cáceres Llica to annul the preliminary arrest as well as the response of the Public ministry. According to the superior judges, all the elements for the application of the coercive measure against the regional authority are met.
During the reading of the judicial resolution, approved unanimously by the superior magistrates Carmen Lajo Lazo, César de la Cuba Chirinos and Jaime Moreno Chirinos, it follows that the escape risk is fulfilled due to the possible penalty that could be imposed on the suspect, which would be greater than four years in prison.

With regard to family, home and work roots, they emphasized this last point and detailed that precisely Carrying out his functional work as a regional authority, Cáceres Llica, as well as the regional officials and councilors, allegedly perpetrated the possible crimes of criminal organization and bribery.
In addition, according to the reading made by Judge De la Cuba Chirinos, of the exposition made by the parties, it appears that the disappearance of evidence or its mutilation is possible, especially of those communications that are consigned in the communication equipment. Likewise, Cáceres Llica would have sufficient financial resources to evade justice.
They even analyzed the audios presented preliminarily and indicated that these become plausible elements of the commission of alleged crimes. The Chamber also reported the impact on human rights caused by the acts of corruption.
For all these reasons, detailed during the reading of the resolution, the higher magistrates They declared the appeal of the defense of Cáceres Llica unfounded.
Challenge against Chamber
At the end of the hearing, lawyer Gonzalo Bellido, defender of one of the parties, decided to challenge (ask the superior judges to withdraw from this case) the Chamber for advancing its decision regarding the case of Cáceres Llica and that – according to He argued – it would set a precedent for the other defendants.
According to Bellido, things like this no longer make sense to continue exposing the defense of the others involved, when the criteria taken into account by the Chamber are already known. In response, the judges specified that there is no reason for them to be inhibited from the case.
In any case, another Criminal Appeals Chamber will decide whether or not these judges continue to see the appeals.
