STF has majority to maintain Collor's conviction in Lava Jato

This Friday (8), the Federal Supreme Court (STF) formed a majority vote to maintain the conviction of former president Fernando Collor to eight years and ten months in prison for passive corruption and money laundering in one of the Operation Lava processes. So far, the Court’s virtual plenary session has a score of 6 votes to 2 to reject a defense appeal against the conviction.

The score was obtained with the vote of the rapporteur, minister Alexandre de Moraes. For the minister, there are no irregularities in the decision that condemned Collor.

“The appealed decision accurately analyzed the entirety of the legal claim deduced, so that, in the present case, the existence of any of these deficiencies is not verified”, argued the minister.

In addition to Moraes, ministers Edson Fachin, Flávio Dino, Cármen Lúcia, Luís Roberto Barroso and Luiz Fux voted to maintain the conviction.

Dias Toffoli and Gilmar Mendes voted to reduce Collor’s sentence to four years because they understood that there was an error in the dosimetry of the sentence. Cristiano Zanin declared himself unable to judge the case.

In May last year, the court found that Collor, as a former PTB leader, was responsible for political appointments to BR Distribuidora, a subsidiary of Petrobras, and received R$20 million in undue advantages in the company’s contracts. According to the complaint, the crimes occurred between 2010 and 2014.

Two of Collor’s former advisors were also convicted, but will be able to replace their sentences with providing services to the community.

The virtual trial is scheduled to end on Monday (11).
