President of the TC confirms meeting with Antauro Humala

The Constitutional Court, through a statement, confirmed the meeting on October 21 between its president, Luz Pacheco, with the leader of the ANTAURO party and sentenced for the murder of four police officers, Antauro Humala.

The statement has four points. In the first and second, the highest constitutional entity indicates that the head of the TC “since she was elected magistrate, she receives all citizens and/or their lawyers, when they have processes pending before the institution, after a duly granted appointment,” and specifies that “for your attention, citizens and lawyers can coordinate the appointment through the presidential secretariat, as it appears on the Court’s website, at the same time, they are subject to the availability of the president’s agenda.”

In the third, the TC reports that with respect to the appointment with Antauro Humala “it did not last more than ten minutes, even though that person spent half an hour in the Court facilities.” “As in all cases,” he adds, “receiving these people does not imply issuing a ruling favorable to the interested parties. It is a moment of listening to the litigants and their lawyers, which is the policy of several magistrates of the Court.”

In the fourth point, it points out that “in the case of citizen Humala Tasso, it should be noted that the file followed in his favor was submitted to the Constitutional Court on September 5, 2024 (File No. 03088-2024-HC); that is , prior to the meeting held on October 21, 2024, so the high procedural burden and the importance of resolving the oldest cases were made known.”

THEY DECLARE IT ILLEGAL

The Judiciary, as recalled, declared, this Thursday, the illegality of the political organization National Alliance of Workers, Farmers, University Students, Reservists and Workers (ANTAUR O), the political movement that sought to bring Antauro Humala, sentenced for the murder of four police officers during the Andahuaylazo, in 2005, to the Presidency of the Republic.

The decision was adopted, by majority, by the members of the Permanent Constitutional and Social Law Chamber of the Supreme Court of Justice.

WILL BE CALLED TO CONGRESS

At the same time, in Congress, and in reaction to this Thursday’s cover of Peru21several congressmen asked to summon the president of the TC (Constitutional Court), Judge Luz Pacheco, to the Oversight Commission, to explain the content of her meeting with Antauro Humala. Parliamentarians Esdras Medina (RP), Héctor Ventura (FP), José Williams (AP) and Silvana Robles (BS) joined that request.

“It’s a bit like haraquiri. Pay attention to a character who is anti-system, who uses the system for his purposes,” says constitutionalist Aníbal Quiroga in an interview with Perú21TV. “There are very important lawyers who have not made an appointment with the president of the TC. And yet, Mr. Antauro Humala is lucky enough to talk with her for 30 minutes. “It’s a bit of an inconsequential topic.”

It should be noted that the Supreme Court’s resolution disqualifies the ANTAURO party, but not the candidate Antauro Humala. If the sentence is upheld, the ethnocacerista could no longer lead a presidential plan with a view to 2026, but he could lead a parliamentary list.

WILL APPEAL RULING

On the other hand, Alex Flores, a congressman who is a member of the National Alliance of University Farmers, Reservists and Workers (ANTAURO) party, announced that his group will appeal the ruling of the Supreme Court that declares its illegality.

“It is an undemocratic, unconstitutional and arbitrary measure because opinion is not punished in the country,” the Antaurist said on RPP this Friday.
