TSJ declares prosecution of Hugbel Roa for corruption admissible

The Full Chamber of the Supreme Court of Justice (TSJ), declared the prosecution of the citizen admissible Hugbel Rafael Roa Carucifor the alleged commission of corruption crimes.

The ruling, with a presentation by the presiding magistrate Gladys María Gutiérrez Alvarado, indicates that in accordance with the request submitted by the Public Prosecutor’s Office, which evidences elements of conviction that compromise Roa’s responsibility, his prosecution by the commission of crimes typified in the Venezuelan legislation against corruption.

The measure indicates that in this proceeding the merit trial is not appropriate and its prosecution corresponds to the competent ordinary courts, according to the provisions of article 378 of the Organic Code of Criminal Procedure.

This is so -explains the source- because it is the flagrant commission of common crimes, in accordance with the provisions of decision No. 1,684, of November 4, 2008, issued by the Constitutional Chamber of the Supreme Court of Justice, and article 116 of the Organic Law of the Supreme Court of Justice.

Orders the judgment that notification be made to the National Assemblydeclaring the detention of the aforementioned citizen admissible, and ordering that the state security forces maintain his custody.

Likewise, it is ordered to refer these proceedings to the Attorney General of the RepublicTarek William Saab, to continue with the corresponding investigation and prosecution, in accordance with due process and the other corresponding constitutional guarantees.
