The expansion of the inquiry Nicholas Gabriel Carrizoarrested and prosecuted as secondary participant in the attempted murder of Vice President Cristina Fernández de Kirchnerscheduled for this Tuesday, was again postponed until January 31 at the request of his defense, judicial sources reported.
This week, federal court 5 is subrogated by magistrate Julian Ercolini and then other magistrates will take charge until Capuchetti returns on January 31: that day, in addition to the inquest being scheduled, he must answer the new recusal raised this Sunday night by the complaint of Vice President Cristina Fernández de Kirchner.
Carrizo had been summoned to expand his investigation on January 5 but the act was postponed, first for this Tuesday after his lawyer Gastón Marano informed the court that due to issues related to the judicial fair he would not be able to be present. Now it has been postponed until the end of the month.
Carrizo had been summoned to expand his investigation as a result of new text messages found on his cell phone in which he attributed participation in the planning of the attack perpetrated against the vice president on September 1.
Judge Capuchetti had summoned him after the Buenos Aires Federal Chamber ordered him to move in that direction based on a proposal formulated by the former president’s complaint that the magistrate had rejected in the first instance.
That claim had been made by the plaintiff lawyers José Manuel Ubeira and Marcos Aldazabal after detecting messages from Carrizo on September 1 in which he stated: “We just tried to kill Cristina.”
“Remember this date”, “This hdp (sic) is already dead”, “You don’t know what we did with this”, “Create fear”, “So that the government knows who they are messing with”are some of the messages sent from Carrizo’s cell phone, head of the group of alleged snowflake sellers for whom those who attacked the vice president worked, as emerged from the filing of the complaint to which Télam agreed.
In that presentation, the lawyers for the complaint warned about the appearance of messages that were not attributed to him in his first investigative statement and that “make an expansion of the accusation prevailing.”
For example, they remarked that after the attack, at 11:17 p.m. on September 1, Carrizo wrote to one of his contacts scheduled as Kevin Bargas 2: “We just tried to kill Cristina” (23.17), “(He was) My employee” (23.17), “He wanted to shoot him” (23.17), “He’s going to jail” (23.17), “The weapon is my friend” ( 23.18), “I swear to God” (23.18), “We are with the group” (23.18), “All together” (23.18).
So far, the attackers Fernando Sabag Montiel and Brenda Uliarte They are prosecuted as co-perpetrators of the attempted murder, while Carrizo was considered a secondary participant, without whom the attack could have occurred just as well.
When they asked to expand the investigations, the lawyers for the complaint demanded that they be prosecuted as members of an illegal association that, in addition to trying to kill the vice president, sought to destabilize the Government.
In relation to this proposal, the judges of the Federal Chamber of Buenos Aires responded: “Regarding the claim of the complainant regarding the modification of the degree of participation originally assigned to Carrizo (…) and that they be saddled with the commission of crime of illicit association, it should be noted that such a matter is within the sphere of analysis and decision of the senior judge at the appropriate time and of the Public Prosecutor’s Office to whom the investigation of the case was delegated.”
