After President Alberto Fernández obtained the endorsement of 12 governors to move forward with the request for impeachment against the Supreme Court and its owner, Horacio Rossati, the formal complaint will be presented to Congress.
For this reason, it is expected that the Government will present this Wednesday the request for impeachment against the Supreme Court before the Chamber of Deputies, so that the measure against the highest court be debated in special sessions of the Impeachment Committee.
In the Commission, the Frente de Todos has a majority, so it is expected that it can move forward with an accusatory opinion, since this is the one in charge of approving the credibility of the accusation against the Supreme Court.
After obtaining the endorsement of the governors, the president argued, through his Twitter account, that he will move forward with the case against the highest court and Rossatti “for having repeatedly engaged in conduct that constitutes the cause of poor performance in their duties provided for in art. 53 of the Constitution”.
The document, which bears the signature of 12 governors, including Axel Kicillof (Buenos Aires), Jorge Capitanich (Chaco), Ricardo Quintela (La Rioja), Sergio Gerardo Zamora (Santiago del Estero), Alicia Kirchner (Santa Cruz) and Raúl Jalil (Catamarca), will first enter the Parliamentary Secretariat.
There, the Chamber of Deputies must declare the complaint admissible in order to begin the investigation, which will be in charge of the Political Trial Commission, which is chaired by Carolina Gaillard of the Frente de Todos.
The request was approved by the governors, within the framework of the dispute over the co-participation ruling in favor of the City of Buenos Aires and the leaked chats between the former Buenos Aires Security Minister, Marcelo D’Alessandro, with Silvio Robles, hand Rosatti’s right.
What is the step by step in Congress
Once the project enters the Parliamentary Secretariat, it will be defined whether the complaint against the highest court is admissible and, if approved, an investigation will be launched to determine if the allegations are true. This stage includes the collection of documentary and testimonial evidence and measures such as visual inspection, if necessary. In addition, the defendants may also present their defense.
Then an opinion will be issued that is approved by a simple majority, with which the complaint is sent to the campus for approval. However, at this stage, two thirds of the votes of the deputies will be necessary for it to be approved and to begin the impeachment trial in the Senate.
