The appeal was filed by the lawyer Wilfredo Robles Riverawho assumes the legal defense of the former head of state after the resignations of Raúl Noblecilla and Ronald Atencio.

In his appeal brief, Robles Rivera maintains that Judge Checkley made an error by not ascertaining whether Congress complied with the procedure established in article 89 of its regulations to lift Castillo Terrones’ prerogative of impeachment.
This measure was lifted on Sunday, December 11 through an agreement of the Plenary of Congress after receiving an official letter from the National Prosecutor’s Office. The respective constitutional denunciation, with which the constitutional accusation procedure begins, was raised by Patricia Benavides the next day, Monday the 12th.
“Congress held session on Sunday, December 11 at 5:00 pm, officiating an agreement with Benavides Vargas that is not the product of a political prejudice. The investigative judge abdicated his obligation to carry out a constitutionality control to comply with a political slogan: everyone against Pedro Castillo!, trampling on the guarantee of due process and turning the preventive detention procedure into a pantomime, into an act of political revenge against the defendant”, considers Robles Rivera.
In this sense, the lawyer accuses the National Prosecutor’s Office of having “deployed an unconstitutional and illegal action” by formalizing the preparatory investigation and requesting preventive detention against Terrones Castle. He also alleges that Supreme Judge Juan Carlos Checkley “has joined” the alleged irregular act.
