The Ombudsman’s Office closed and archived the request for mediation filed by the National College of Pharmacists (Conalfarm) due to the lack of response from the Social Security Fund (CSS) to address health issues.
On November 14, the Ombudsman, Eduardo Leblanc, notified the director of the CSS, Enrique Lau Cortés, of the mediation resolution M-5066 presented by the president of the Board of Directors of Conalfarm, Jaime Olive and Blanca Gómez.
In said mediation, they requested the intervention of the Ombudsman’s Office in order to deal with health issues, such as that the design and operation of the health system respect basic principles, common to human rights, and that it is not limited to curative, care the disease and treat the underlying factors and determinants of health.
Conalfarm also requested the CSS to have an information system, indicators and goals, from a human rights perspective, that allows a clear evaluation of progress and setbacks in the satisfaction of the right to health.
The Ombudsman’s Office concludes that the lack of response from the CSS makes them understand their tacit resignation to participate in the mediation requested by Conalfarm.
Leblanc determines that “the CSS has not provided a formal response in which it informs us if it accepts the requested mediation, for which it gives us to understand a tacit refusal, that they do not agree to their participation in the mediation described, for which reason it is concluded and mediation request filed.
The National College of Pharmacists expressed its concern that the general director of the CSS, who claims to have an open-door administration, is refusing to allow the first social security institution to develop guidelines and protocols on medicines.
