While in November and December of last year, 312,902 jobs were lost, of which 69.1 percent were jobs registered as permanent, in 2022 the dismissal of employees by the end of the year continues. The federal government has already identified employers who resort to this irregular practice, since they are usually rehired the following month.
In a joint statement between the Mexican Institute of Social Security (IMSS), the National Housing Fund for Workers (Infonavit) and the Ministry of Labor and Social Welfare, it was warned that Although there are legitimate temporary contracts, the truth is that many of the workers terminated in December and rehired in January are registered by the employers with the IMSS as permanent; therefore, these casualties are a totally irregular practice
.
At the beginning of 2022, 126,256 employees who had been terminated a month earlier re-signed with the same company. For the third year in a row, the federal government identified employers who, historically, during December, dismiss workers from the IMSS and Infonavit to call them back in January of the following year
.
Given this, the three agencies sent letters to the employers who allegedly engage in these practices with the purpose of reviewing whether the management of its workforce is in accordance with the current regulatory framework and avoiding actions that violate the rights of the workers concerned, as a consequence of evading labor and social security obligations
.
They underlined the importance of workers and their families always being protected with all the benefits to which they are entitled
and warned that non-compliance with labor and social security obligations, in addition to cause employers to face administrative and criminal liability
can put the finances of companies at risk.
