This Tuesday, January 18, the death of the stylist Maurice Leal, who was found with his mother, Marleny Hernández, lifeless at the end of November 2021, began to clarify.
His brother, John Leal, accepted, in full court hearing, having murdered Mauricio and his mother.
“I have made the decision, freely and voluntarily, to accept the charges through an agreement with the Prosecutor’s Office and I take the opportunity to express my repentance asking for forgiveness, first of all, from my family.“Jhonier said before a judge.
At first, everything pointed to the stylist killing his mother and then taking his own life.
However, it was soon found that Mauricio, already wounded and under the effect of some tranquilizing pills, was forced by his brother to write a note in which he showed himself to be responsible for the events and he left all his possessions to his brothers and nephews.
YOUR BUSINESSES AND ASSETS
According to the investigations, Jhonier wanted to keep his brother’s inheritance and, after his death, he would have started the succession process so that everything would be under his control.
Within the businesses and assets of Mauricio Leal there were two properties, two companies, two commercial establishments, two cars and a motorcycle. Y everything would be valued at almost 5,000 million pesos.
Among all this there is a hairdresser in the middle of the pink zone of Bogotá and a house in La Calera (where he was found dead).
With Jhonier’s confession, what will happen to the goods and businesses of Mauritius?
The first thing to make clear is that the authorities are investigating whether the stylist earned his fortune legitimately or if, on the contrary, it is linked to money laundering.
For this reason, the Prosecutor’s Office imposed precautionary measures for the purpose of forfeiture of all the properties and assets of Mauricio Leal.
Lawyer Francisco Bernate explained that if prosecution manages to establish that there is money laundering, that these assets come from something illicit, they would become controlled by the Special Assets Company (SAE).
Bernate stated that, if the businesses and assets are in the name of Mauricio Leal and he did not leave them to anyone, they fall under the legal order of succession: children, parents, siblings, a relative. “If you are totally alone, they would go to the State, but that is the last scenario”.
If they are in the name of companies, “liquidated and paid to debtors and creditors”.
And, if he left a will, whoever left them will be responsible, as is the law in the country, a quarter of that he left behind.
Regarding the conviction of Jhonier Leal, Bernate explained that a sentence of two aggravated homicides and by destroy evidence, which is your case, it would be between 40 and 50 years, “but to that we must apply the discount for her agreement with the Prosecutor’s Office, which would leave her between 20 and 27 years, I predict”.
In addition, it would have other discounts, as illustrated by Bernate: “For every two days of study and work in prison, one day of imprisonment is reduced. So what would happen in jail, I think, would be 15 years”.
