President Jair Bolsonaro granted this Friday (24) the Christmas pardon. The decision includes detainees with health problems, in addition to military personnel and agents of the Public Security System who have committed crimes with culpable excess, such as police officers.
Paraplegic, quadriplegic inmates who have acquired visual impairment after the crime, people with serious illnesses that limit activities and require continuous care impossible to be provided by the prison unit’s staff, and individuals with HIV/AIDS in the terminal stage will be entitled to the benefit.
In the case of agents of the Public Security System, people convicted as a result of exercising their functions for crimes with culpable excess or crimes without intention were benefited, provided they have served at least one sixth of the sentence.
The soldiers included in the pardon are those in Law and Order Guarantee Operations and who have been convicted of a crime with negligible excess.
Persons convicted of heinous crimes, torture, terrorism, money laundering or concealment of goods, drug trafficking, violence and sexual harassment, embezzlement, influence peddling and committed by criminal organizations cannot enjoy pardon.
Persons who had their prison sentence replaced by alternative punishments were not included in the pardon decree. According to the Presidency of the Republic, the measure repeats decisions from previous years and is motivated “for reasons of a humanitarian nature”.
