Ethics Directorate warns of lack of integrity in PROPEEP management

SANTO DOMINGO.- The General Directorate of Ethics and Government Integrity (DIGEIG) responded to the request of the General Directorate of Public Procurement and Contracting (DGCP) to issue its opinion on possible ethical and moral faults incurred by those responsible for the program “Paint your neighborhood in Christmas,” of the General Directorate of Strategic and Special Projects (PROPEEP), according to a report broadcast on the television space “El Informe”, directed by journalist Alicia Ortega.

After evaluating the aspects of interest submitted for consultation by the DGCP, the DIGEIG, in a communication signed by its head, Milagros Ortiz Bosch, presents several conclusions and recommendations in which it specifies the powers that correspond to the related institutions and proposes to submit the report to Procompetencia “so that within the framework of the Constitution and the laws it determines the participation or not of the related companies”.

Specifically, it understands that there is a lack of integrity in the management of PROPEEP, expressed in the explanation of this entity by limiting itself to presuming the regularity of the process in good faith, and not carrying out additional procedures in the understanding that other institutions would carry out the verification” .

He points out that “in the moral and ethical behavior of public servants, when analyzing their performance from Integrity, we affirm that in the public administration system there is no fragmentation of processes, no delegation to third parties, and no assumption of good faith. The full responsibility of the administrative processes is the obligation of the officials who exercise the Maximum Authority”.

“We suggest that the Legal Consultancy of the Executive Power, in coordination with the Judicial Power, the academies and the institutions linked to the business sector and to national and international trade, work with the governing body, Procompetencia, to identify the weaknesses of the laws and procedures in the matter in order to create and disseminate rules that contribute to the strengthening of free trade and free competition and transparency”, exposes the letter addressed by Ortiz Bosch to Carlos Pimentel, general director of Public Procurement and Contracting.

Likewise, it recommends contributing and collaborating with the regulatory compliance programs executed and implemented by the General Directorate of Ethics and Government Integrity, contributing to the training of all sectors involved in strengthening the values ​​and regulatory principles of best business practices.

It establishes that the DGCP, that PROPEEP is responsible for receiving, verifying and certifying the quality and verifying the quantity received of the goods acquired to be delivered by the supplier, and who should notify the DGCP of irregularities or non-compliance by of the suppliers, in case of having identified any non-compliance.

In its response to Pimentel, the General Directorate of Government Ethics and Integrity indicates that, without prejudice to the legal powers of the Ministry of Public Administration, in its capacity as the governing body of the public function, it considers it pertinent and necessary to recommend the following guarantee measures to the regime of integrity in the public function:

a. Give a period of 15 days to organize with the National Institute of Public Administration and the DGCP, a special course on the Public Procurement and Contracting System, in which public servants from the purchasing, legal, budget and administrative areas must participate. of the Ministry of Special Programs of the Presidency. That the Ministry of Public Administration convene a dialogue with officials and the highest authority of PROPEEP, to reiterate the principles that govern public administration, emphasizing that its function does not allow the delegation of the responsibilities inherent in its positions and reiterate the obligation of normative compliance.

b. Strengthen the presence and follow-up in PROPEEP of the Compliance Officer in the purchasing department, under the guidance of the DGCP as established by Decree No.326-21.

c. Organize a workshop on the importance of transparency and perception in the Public Administration.
