TSE minister denies PL's request to remove Lula's video from the internet

Minister Raul Araújo, of the Superior Electoral Court (TSE), denied a request made by the PL to remove from the internet a video of the public act that had the participation of presidential candidate Luiz Inácio Lula da Silva, in Fortaleza, on July 30 . TSE minister denies PL's request to remove Lula's video from the internet

In the representation sent to the TSE, the party claimed that Lula made early electoral propaganda in his own favor and against the reelection candidate Jair Bolsonaro. According to the PL, Lula would have adopted Bolsonaro’s “hate speech and insults to honor” by calling him a “liar” and a “coward”.

In the decision handed down on Wednesday (10), the minister understood that there was no explicit request for votes and that the lines contained in the speech are critical considerations against the opposing candidate.

“The speech given by the represented Luiz Inácio Lula da Silva does not contain an explicit request to vote, it is embodied in the exaltation of his personal qualities, reveals critical opinions to his opponents, as well as externalizing personal thoughts on issues of a political nature. In this context, in judgment of summary cognition on the claim articulated in the initial petition, everything indicates that the speech given by the represented does not exceed the limits imposed by electoral legislation on the exercise of public freedoms”, decided the minister.
