Federal judge Ariel Lijo was drawn this Thursday to intervene in a complaint filed by the judge of first instance in Contentious, Administrative and Tax matters of the city of Buenos Aires, Roberto Gallardo, for possible violation of the Intelligence Law by authorities of the Buenos Aires Government, within the framework of the use of the facial recognition system for fugitives (SRFP).
Lijo was in charge of the complaint that Gallardo filed electronically on Wednesday night against Marcelo D’Alessandro, Minister of Justice and Security of the CABA; and Gastón Leopoldo Navarro, undersecretary of Technology and Informatics of the Ministry of Justice and Security of the CABA, informed judicial sources.
Also against Cecilia Inés Amigo (coordinator of the Comprehensive Video Surveillance Plan of the CABA, within the scope of the Ministry of Justice and Security of the CABA); and Mariano Córdoba (Head of Systems of the Undersecretary of Technology and Informatics in the area of the Ministry of Justice and Security of the city of Buenos Aires).
The magistrate filed the criminal complaint after the news of his apartment was knownby the Superior Court of Justice (TSJ) of the City of Buenos Aires, of the cause in which possible irregularities are investigated in the use of biometric data by the City of Buenos Aires within the framework of the SRFP.
“The information collected even up to this stage of the case allows us to observe the possible improper use of biometric data by certain employees of the Ministry of Justice and Security of CABA,” Judge Gallardo said in the official letter he sent to the National Chamber. of Federal Criminal and Correctional Appeals based in Comodoro Py 2002.
In the office to which Télam agreedJudge Gallardo recalled that “the Fugitive Facial Recognition System will be used only for tasks required by the National, Provincial and Autonomous City of Buenos Aires Judiciary, as well as for the detection of people wanted exclusively by court order. , registered in the Database of National Consultation of Rebellions and Captures (Conarc)”.
He also highlighted that, according to current regulations, “except for a court order, it is prohibited to incorporate images, biometric data and/or records of people who are not registered with Conarc.”
As he was able to reconstruct this agencyin the last days Judge Gallardo had received the results of the expert opinion required from the Airport Security Police (PSA) in relation to the elements seized in the case from which he was removed and there it was asserted that “there are people who should not be found in the SRFP database.”
The same report stated that “it was established that the alerts issued by the SRFP to the different police officers, for the arrest of people, are sent through the instant messaging program Telegram indicating that there is no insurance for the treatment of sensitive personal data”.
