Judge Raúl Justiniano Romero declared inadmissible the request for the search and seizure of the video cameras of the presidential residence and Government Palaceduring the location and capture of the president’s sister-in-law peter castle, Yenifer Paredes Navarro. According to the resolution, to which La República agreed, the Eighth Preparatory Investigation Court of the National Superior Court of Justice rejected the request of prosecutor Hans Aguirre Huatuco, representative of the Special Team of Prosecutors against Corruption of Power.
Prosecutor Aguirre indicates in his request that, on August 9, the representatives of the Special Team were aware that Yenifer Paredes was in the facilities of the Palacewhen they proceeded to execute the intervention and capture of the investigated.
To this, it indicates that, not finding it, they asked security personnel to “show the video camera of entry and exit of personnel located on the outside of the residence and inside the rooms of the presidential office, having refused to for the reason that this request did not include the judicial proceeding.”
Regarding this, Judge Raúl Justiniano replied that “Although it is true that the raid also included the seizure of assets linked to the alleged commission of the crime for money laundering and criminal organization, neither in the fiscal requirement nor in the aforementioned resolution was it authorized to collect, confiscate or request a copy of camera recordings. located in the property subject to the search, even more so when the facts investigated do not include the date of the act of search”.
Likewise, he stated that the authorization was approved for the area of the residence of the Government Palace; this to the extent that the Public Ministry has affirmed that the investigated Yenifer Noelia Paredes Navarro would live in said property, which did not include or understand the presidential office or the residential environments of President Pedro Castillo, except for the House of Pizarro.
Along these lines, he adds that “In the case of the fiscal requirement linked to the Government Palace, it is linked to the president and, if the Public Ministry intends to investigate it, it must proceed in accordance with the provisions of article 99 of the Political Constitution of the State.”.
“We have that said fiscal requirement is not urgent to be attended to, since, from the first requirement to date, the Public Ministry has had the necessary and sufficient time to formulate its request before the competent authority.”
“For the reasons stated, it is resolved to declare the request for the search and seizure of the video cameras of the presidential residence and the Government Palace inadmissible,” reads the resolution issued by Judge Raúl Justiniano.
