The controversy has accompanied Yasmín Esquivel since before reaching the Supreme Court of Justice of the Nation (SCJN). Since she was included in the shortlist to occupy the space left by Minister Margarita Luna Ramos, her application caused disagreement for being the wife of businessman José María Riobóo, who was a contractor and advisor to President Andrés Manuel López Obrador on construction issues, including Felipe Angeles International Airport (AIFA).
Esquivel Mossa was nominated by President López Obrador along with Loretta Ortiz and Celia Maya. Since the shortlist was made public, the controversy arose and the candidate had to respond to the accusations.

The vote will take place on January 2 and the minister who is elected will be in the presidency of the Court until 2027.
Esquivel Mossa has already filed a complaint with the authorities for the alleged plagiarism of which he would have been a victim.
