In session of the Superior Chamber, the Electoral Court of the Judicial Power of the Federation rejected a challenge presented by one of the candidates for District Judge, who requested that, given the vacancies declared by the National Electoral Institute (INE) in the recent judicial election – due to lack of accreditation of the academic average -, it would automatically designate the second place of the contest.
With this decision, in what was one of the first deliberations about vacancies derived from the judicial electoral process, the Court left the criterion on how these places should cover themselves, after the disqualification of the winning candidates.
In addition, the TEPJF declared inadmissible a challenge filed by the PAN against the declarations of validity of the magistrate elections in the regional halls of the Electoral Court itself. The body resolved that the PAN lacks legal legitimation to present resources related to the election of members of the Judicial Power of the Federation.
During the session, the magistrates also discussed the procedure that should be applied in cases where the winners were disqualified by not complying with the constitutional requirement of the minimum academic average.
Judge Reyes Rodríguez Mondragón proposed that in those cases the entire electoral process be repeated. However, his approach did not obtain support among the rest of the members of the Chamber.
The project was finally rejected by majority, without establishing a clear precedent for future challenges on similar situations.
