The withdrawal of money from your AFP it is already a reality. This Tuesday, May 31, it was published in the newspaper El Peruano that as of June 13, members will be able to withdraw up to 4 Tax Units (UIT), equivalent to 18,400 soles from the AFP pension funds.
Through SBS Resolution No. 01767-2022, the Superintendence of Banking, Insurance and AFPs (SBS) details that the operating procedure applies to AFPs and establishes the corresponding regulations to comply with the provisions of Law No. 31478.
WHEN WAS THE LAW PUBLISHED?
Law No. 31478 was published in the Official Gazette El Peruano on May 21, 2022, which extraordinary authorizes AFP affiliates a new withdrawal of funds accumulated in their individual capitalization accounts (CIC) in the context of the covid-19 pandemic.
Given this, the operating procedure states that the affiliate who decides to withdraw their funds from the AFPs, under the scope of Law No. 31478, must submit their request within a maximum period of 90 calendar days, the beginning of which is counted from the entry into force of this resolution (June 13, 2022).
UNTIL WHEN CAN I SUBMIT THE APPLICATION?
Therefore, the affiliate may submit his withdrawal request, one time only, starting next June 13, and the deadline for submitting applications expires on September 10, 2022.
In addition, if a member wishes to withdraw from his withdrawal request, he can notify the AFP, up to 10 calendar days before the date on which any of the three disbursements have been scheduled, revoking the payment of future disbursements that would have been scheduled.
WHO WILL BE ABLE TO WITHDRAW PART OF THEIR FUNDS IN THE SIXTH AFP RETREAT?
The law allows all AFP affiliates who are not of retirement age to be able to withdraw funds.
The measure also excludes those who withdrew up to 95.5% of their Individual Capitalization Account (CIC) and affiliates covered by the Special Early Retirement Scheme (Reja).
HOW COULD THE SIXTH WITHDRAWAL OF AFP FUNDS BE MADE?
The Law indicates that the disbursement be in three parts, as on previous occasions:
- First part: Up to one UIT (S/4,600) 30 days after the request is computed.
- Second part: Up to one UIT (S/4,600) 30 days after delivery of the first amount.
- Third part: Up to two UIT (S/9,200) 30 days after the second delivery.
WHAT HAPPENS IF I MADE THE REQUEST, BUT I NO LONGER WANT TO WITHDRAW THE MONEY FROM THE AFP?
In the event that the affiliate decides to stop withdrawing his funds from his individual capitalization account, he may request it from the AFP up to 10 calendar days before the disbursement.
In addition, the withdrawal of funds maintains the condition of intangible, and cannot be subject to discount, legal or contractual compensation or any affectation, whether by judicial or administrative order.
