Withdrawal from AFP: Judiciary can seize up to S/6,420 for alimony

The amounts obtained with the eighth withdrawal of AFP funds can be seized or withheld in case of alimony debts, as stipulated in the rule that allows the provision.

In these cases, the court may order that up to 30% of the withdrawal be used to pay the pending obligation. According to the rule, each contributor may withdraw up to S/ 21,400 (equivalent to four UIT).

Of this amount, Up to S/ 6,420 could be seized if there was a judicial food process in progress.

However, This discount is not automatic and only occurs at the request of the plaintiff and through a court order, it was reported.

The chief judge of the First Law Court of Peace, César Marroquín Minaya, confirmed to the agency Andean that this legal mechanism requires an express request from the person (claimant) claiming the pension to be activated.
