With protection, 94 women seek to decriminalize abortion in Quintana Roo

The amparos also ask to eliminate the 90-day limit for abortion due to rape, in accordance with the provisions of the SCJN, which declared the criminalization unconstitutional in this case.

“The importance of eliminating the lapse as a requirement to access an abortion for rape is not something new, not even that it is in Mexican legislation. The Inter-American Court has said that forcing mothers under these conditions is considered a case of torture,” he told Political Expansion Silvia Chuc, also from Governance Mx.

Vanesa González-Rizzo, a specialist in gender issues, commented that she is currently accompanying the case of a girl raped by her cousin, who became pregnant and that they did not evaluate the options of filing a complaint and abortion until she was five months pregnant. The activist said that it is not an isolated case, but that there are several girls with similar cases who have given legal advice.

Since the pandemic, Quintana Roo has been among the top places in terms of rape rates, with 794 investigation files for that crime in 2021 alone.

“In the case of our state, sexual violence is one of the main crimes against women and girls. As a result of the pandemic, this grew terribly, to the point of becoming the first entity in the country with the most cases of rape. Derived from this, surely there have been pregnancies as a result of this relationship. And limiting access to abortion in a temporality that is almost rape, goes against all the guidelines of the dignity of the victims. In addition, the victims, many times, denounce until they can, not when they want”, added Chuc.
