In recent weeks, the surname of the Carabineros corporal has been written and pronounced countless times. After a couple of weeks of frantic sessions in Congress, the parliamentarians of the Chamber and the Senate cited his case over and over again until the law, named Naín-Retamal, was finally approved with the help of all political forces with representation in Parliament.
But while this was happening, the criminal investigation for the murder of Corporal Naín continued its litany course, which drowned his widow, who admits feeling desperate due to the lack of diligence in a case where two of the three responsible for the murder are still fugitives.
Dahianna Pereira lost her husband in October 2020 in the line of duty. Eugenio Naín was only 24 years old when he was fatally shot in the middle of a barricade set up by a group of protesters on the highway near the town of Metrenco in the Araucanía region.

“The truth is, I haven’t had much communication with the prosecutor. The investigation has been very slow”, confesses Dahianna.
Until now, the only detainee is Luis Tranamiel Nahuel, while of the other two, identified as Francisco Painevilo Maldonado and Carlos Cancino Tapia, there is not the slightest trace. The prosecutor in the Carlos Bustos case confirmed that there are arrest warrants in force against these two people.
-Do you think that more efforts could be made to find these people? “Of course,” he replies, “I feel anger, helplessness and the desire to do justice with my own hands,” replies the 24-year-old widow of the carabiniere.
Dihanna through some media has expressed her opinion on the Naín-Retamal law, declaring that the regulations should seek that the police defend themselves against criminals and terrorists, but not against people.
The project approved by Parliament, which gives greater powers to the police, was inspired by Naín and by the death of 24-year-old Second Sergeant Carlos Retamal, also in October, but two years earlier. The corporal of Mapuche origin was killed in an act of service in the middle of a shootout in the context of a roadblock. While Sergeant Retamal suffered a fatal attack when he was supervising a clandestine car race in San Antonio.

According to the investigation by the Public Ministry, the events that ended in the death of Naín began when a group of seven individuals blocked the road with barricades in protest against the eviction of a property in the Renaico sector, in La Araucanía. When the uniformed officers arrived at the scene, they were greeted with shots by the group of protesters. One of the bullets hit Corporal Naín, causing his death.

The only person arrested for this case is Tranamil. Since his arrest, he has been in pretrial detention in the Temuco prison in the module intended to house Mapuche community members who are serving sentences or awaiting trial. Four times his defense has requested the city’s Court of Appeals to change the precautionary measure, always being rejected.
The Prosecutor’s Office requests for Tranamil sentences that add up to more than 40 years in prison for his participation as author in the crimes of consummated homicide of a police officer in the act of duty, frustrated homicide of a police officer, simple homicide and illegal possession of a firearm.
