In the afternoon of this August 1st, the Council of State admitted a new lawsuit against the election of Leopoldo Munera Ruiz as rector of the National university of Colombia.
“The Fifth Section concluded that defining the scope of the decisions adopted by the Higher University Council of the National University, before the appointment of Leopoldo Alberto Múnera Ruíz (Res. 067 of 2024), requires the exhaustion of the probationary period and is an aspect that must be resolved in the ruling that ends the controversy.“the high court said in a statement.

Nevertheless, The court stated that it denied the request to provisionally suspend the legal effects of the acts containing the appointment of the lawyer and academic as the senior manager of the most important public higher education institution in the country.
Therefore, “The electoral process will continue its course and the sentence will be issued where it will be decided regarding the legality of the election that is being requested to be annulled.”.

The lawsuit was filed by the citizen Jorge Alberto Espinosawho requested the annulment of the Minutes of extraordinary session number 10 of June 6, 2024 of the Higher University Council (CSU)in which Múnera was elected as rector; indicating that she was surrounded by “real irregularities“, citing that the same corporation that appointed him had also appointed Professor to that position on March 21 Jose Ismael Penawho completed one month and six days at the helm of the National.

However, this request was denied after the Section considered that “It is not possible to define the scope of the decisions adopted by the CSU in Resolution 067 of 2024, regarding the election that is being requested to be annulled, in addition to the lack of evidence (administrative records), which must be used to resolve the controversy that the plaintiff intends to bring.“.
