Decree 851 of 2024 establishes that the National Penitentiary and Prison Institute (INPEC) must implement measures to block and prevent unauthorized communications within seclusion establishments, including the use of mobile terminal equipment and other wireless communication systems.
In addition, the Law 65 of 1993which regulates the penitentiary and prison code, points out that the restrictions imposed on persons deprived of liberty must be proportional and necessary, but also establishes that the use of unauthorized communication technologies is prohibited.
Therefore, the creation and dissemination of content on social networks from inside a prison is not legally authorized in Colombia; However, it is known that some informative channels, creators of content and research reporters have had access in their moments to record life stories of people deprived of liberty in Colombia.
Was there any authorization for Andrés Ricci to publish the video?
