After the Death of former President Alberto Fujimorimany are wondering what will happen to the life pension that was granted to him as former President of the Republic, as well as the debt for civil reparation that he had to pay. Will these be inherited by his children?
César Delgado-Guembes, a constitutional lawyer, was consulted on this matter and clarified that the life pension could be inherited by his relatives, however, only by his spouse, minor descendants or adults, but eligible for guardianship.

“Given this situation, we have doubts about Mr. Fujimori’s marital status,” he said in an interview with RPP.
In this regard, he indicated that the former president’s ID card shows him as “divorced” from Susana Higuchi, however, the life pension could correspond to Satomi Kataoka “if Fujimori had married her during his stay in Japan.”
“If she were to maintain a relationship with Mr. Fujimori, we would expect her to appear in person to request this life pension, proving that there is indeed a marriage certificate; however, according to Peruvian law, Mr. Fujimori’s ID card shows him as a divorced person,” the lawyer clarified.
“That is what we do not know and it would be pending a solution based on the evidence that is accumulated regarding the existence or not of a marriage with a person in Japan,” he concluded.
On the other hand, he said that, following the death of the former president, the criminal proceedings that had been initiated or are intended to be initiated against him “have expired”, since it is “impossible to condemn a person who has died.”
As a result, the payment of civil compensation amounting to 57 million soles, which he owed to the Peruvian State, is void. This is after three cases for which he was sentenced by the Judiciary.
“The compensation that has been the result of criminal proceedings that have already been concluded and in which Mr. Fujimori was found responsible also expires,” the lawyer said.
Compensation, not being of a criminal nature and individual responsibility, cannot be delegated or inherited by their children.
