What is a working day?
The Federal Labor Law establishes that a “working day” is the time during which the worker is available to the employer to provide their work.
Types of working hours according to the LFT
daytime
It is located within the period of 6:00 a.m. to 8:00 p.m. (48 hours a week or 8 hours a day).
nocturnal
It corresponds to the period of 8:00 p.m. to 6:00 a.m. the next day. (42 hours a week or 7 hours a day).
mixed
Adopt the periods of both days, (45 hours a week or 7 and a half hours a day). However, if more than 3 and a half hours of the night shift are worked, it is counted as a night shift.
Maximum duration of the working day
ok not the Federal Labor Law, the maximum duration of the day will be: eight hours during the day, seven hours at night, seven and a half hours the mixed.
Rules on working hours
The Federal Labor Law includes other regulations related to the working day that are:
- The worker and the employer will determine the duration of the working day, without exceeding the legal maximums specified in the previous table.
- The worker and the employer may distribute the working hours, in order to allow the former to rest on Saturday afternoon or any equivalent modality.
- During the continuous working day, the worker will be granted a break of at least half an hour.
- When the worker cannot leave the place where he provides his services during the hours of rest or meals, the corresponding time will be computed as effective time of the working day.
