What does a state of emergency mean in Lima?: restrictions that the government of José Jerí would apply

The government of the interim president José Jerí announced that it will declare a state of emergency in Metropolitan Lima in response to the increase in violence and insecurity, amid growing popular rejection of police repression during recent mobilizations. The measure would allow restricting constitutional rights such as freedom of movement, assembly and the inviolability of the home, in addition to authorizing greater intervention by security forces in the streets.

The president of the Council of Ministers, Ernesto Alvarezthis Thursday announced that the declaration will be made. “It cannot be a symbolic measure,” he said. “We are going to declare a state of emergency in at least Metropolitan Lima, but that cannot be an ethereal measure. It must be accompanied by a package of concrete and effective actions.” Álvarez commented that the cabinet remains in permanent session to define concrete and effective actions, and did not rule out imposing a curfew, although he said that it must be technically justified.

The decision comes after the protests of October 15, the day on which the young man was murdered Eduardo Mauricio Ruiz Sanz, known as Trvko, shot by a police officer. The National Police of Peru itself confirmed that the perpetrator of the shooting was identified as a non-commissioned officer, who was removed from his position while the Prosecutor’s Office opened an investigation. The death of the young man, recorded on video, unleashed a wave of indignation and vigils in Plaza Francia, in which hundreds of people demanded justice.

The congresswoman Susel Paredesthrough their social networks, expressed their rejection of the measure and pointed out that this will not solve anything. “2 transporters murdered, and 4 more injured victims of crime, how many more families are going to be broken before they do something? And the government, continuing Dina, only announces a state of emergency when it is already known that it is useless in the face of this problem!”, he wrote.

Despite the criticism, the Executive insists that the measures seek to “recover order.” However, so far it has not detailed the time limits or safeguards that guarantee respect for fundamental rights and civilian supervision of the security forces.
