The Specialized Court of Justice today revoked the order of 24 months of preventive detention against the lawyer Mateo Castanedaaccused of being part of the criminal network Los Waykis en la Sombra along with Nicanor Boluarte, brother of President Dina Boluarte.

During the virtual hearing, the judges of the Fifth Criminal Court of Appeals reported that laws 32108 and 32138, recently approved by Congress, should be applied, which modify the rules and specify requirements to identify a criminal organization and its members.
For example, the court indicated that the crime of influence peddling that the accused is accused of only punishes with three years in prison, which does not reach the minimum prognosis of five years to order preventive detention.
The magistrates also concluded that the new laws require that to determine a criminal organization there must have been an economic purpose involved, something that has not been demonstrated so far in the Castañeda case.
The lawyer is accused of having been the legal arm of the Boluartes to neutralize the investigations undertaken by the Public Ministry.
In this regard, the court warned that there are audios recorded by PNP Colonel Harvey Colchado where he warns that Castañeda would have tried to learn about the fiscal strategy in exchange for offering the police officer his permanence in the position.
Due to this, although his release was issued, the lawyer will not be able to leave the country for 36 months and must pay a bond of S/10,000.
