Victor Rodriguez Montezaformer supreme prosecutor whose dismissal in the Public Ministry occurred due to alleged links with the criminal organization ‘Los Cuellos Blancos del Puerto’, he was presented before the Constitutional Court (TC) after filing a request for protection with which it seeks to annul said sanction. The former magistrate told the judges that his dismissal, ordered by the National Board of Justice (JNJ), was “unfair.”

“I want to say that I have been unjustly dismissed after a career as first supreme deputy prosecutor and then titular supreme prosecutor, in which I have not had any observations regarding my conduct throughout my career (…),” he said during the session of the highest interpreter of the Constitution.

According to the argument Rodriguez Montezathe JNJ dismissed him outside the deadline established to carry out the disciplinary process. The former prosecutor maintains that on November 24 he presented a request for the process to expire due to the expiration of the deadline; that that same day the plenary session met urgently and approved his dismissal; that the resolution appears dated the 24th, but was signed on the 25th; and that it was only on the 25th that it was notified. With this, it seeks to suggest that the decision was adopted hastily or with formal inconsistencies that could affect its validity and violate due process.

As is remembered, Rodriguez Monteza would have alerted members of this alleged criminal network that their calls were being intercepted. “Here I come for justice, perhaps beyond the facts, for a justice of due process. What has happened is that the expiration period has not been respected,” he indicated.

“They are all conjectures, statements from third parties, from people who don’t even know me, but affirm this or that thing. They are people who, in a secret statement, said one thing, but in a public statement and in front of lawyers they changed the version. However, any version that could be favorable to my total innocence was not valued and only these conjectures that come from presumptive indications, which in reality are poorly constructed fallacies, were taken,” he mentioned.

As already mentioned, the JNJ opened disciplinary proceedings against Rodriguez Monteza for allegedly having warned those involved in the network about telephone interceptions and tax proceedings, events that were considered as possible very serious misconduct in the exercise of his function as supreme prosecutor.

During the process, the JNJ evaluated audios, testimonies and fiscal actions linked to the case. Rodríguez Monteza exercised his defense and questioned the legality of the process, alleging violations of due procedure. However, the plenary session of the JNJ concluded that there were sufficient elements to establish disciplinary responsibility, considering that his conduct compromised the independence and probity required by the position of supreme prosecutor.

In November 2021, the JNJ decided to remove him as the titular supreme prosecutor and cancel his title, determining that he incurred very serious offenses. The decision ended his career in the Public Ministry.
