Uruguayan Justice dictates the first sentence in its history for transfemicide

This was explained to Efe by the transfeminist activist Josefina González, who, after witnessing the hearing, explained that the judge in the case, María Sunhary, classified the sentence on the basis of a “especially aggravated homicide”, based on the Law of Violence Based on Gender and the Penal Code.

“This speaks of an accessibility to Justice and that is not minor, because we come from not being included in the system and being outside all the institutions,” he said.

Likewise, he described this fact as “historic” both in his country and in Latin America, since it is the second sentence of this type after Argentina in the region.

“This has to do with recognizing trans identities and acknowledging the historical, structural and systemic violence that we have suffered during all these years in our towns,” he said.

In turn, he stressed that after this ruling a precedent is “set” within the jurisprudence of that country, which can be used in similar cases.

According to the local press, Fanny Aguiar, 37, was stabbed to death inside her residence on November 15, 2018 by her partner, who was later arrested by local authorities along with a companion who was released.

Both had been serving preventive detention since that year.

Uruguay has a Gender-Based Violence Law, approved in January 2018, and a Comprehensive Law for Trans People, which dates from October 2018.
