Upper uphill, Mexico’s struggle against arms trafficking with Trump

Battle obstacles

Weapons are not only an issue that affects Mexico. A report from the alcohol office, tobacco, firearms and explosives in the United States reveals that drug cartels are being assembled through traffic channels from US territory and that 82% of trafficked weapons go to territories controlled by the Sinaloa cartel and the Jalisco cartel New generation.

And beyond that Trump has not spoken against weapons, on February 7 signed an executive order “To protect the rights of the second amendment of all Americans.”

“Within 30 days as of the date of this order, the Attorney General will examine all orders, regulations, guidelines, plans, international agreements and other actions of the departments and executive agencies (agencies) to evaluate any infraction in the course of The rights of the second amendment of our citizens, and will present an action plan proposed to the President, through the internal policy advisor, to protect the rights of the second amendment of all Americans, ”says the order.

Given the complicated panorama to contain arms traffic, Víctor Manuel Sánchez considers that a first step can be to restrict the sale of certain types of weapons.

“The substantive solution would be that the sale as in Mexico is limited to non -automatic weapons, I mean, that is, you can buy a weapon, but not a high and not repetition caliber, that is, it is not like a machine gun that takes out a burst, but therefore a weapon that implies that you disagree with bullet. And that substantially changes the amount of dead. It is known that in the United States those states that have managed to put state restrictions for the sale of automatic weapons, for example, Massachusetts have a lower incidence of these multiple murders, ”he says.

Ongoing, two demands for weapons in the US

Last Friday, President Sheinbaum announced that, if the United States designates as Foreign terrorist organizations to Mexican cartelsMexico will expand at least one of the demands that the government has against the American arms manufacturers.

“Mexico has an international demand against weapons and distributors manufacturers in the United States. If they came to decree organized crime groups as terrorists, since we would have to expand the demand in the United States because then, as the department of the department itself recognized Justice, that 74% of the weapons of criminal groups come from the United States, because how are the shipowners and distributors in front of the decree? “The president questioned.

In 2021, the Federal Government filed a lawsuit in Boston, Massachusetts, against eight manufacturing and distributors of arms in the United States; He accused them of acting “negligent” by allowing their products to end up in the hands of organized crime in Mexico.

A year later, he processed a second lawsuit in Tucson, Arizona, against five stores in that state, after detecting that a good part of the assured weapons in Mexico were acquired in those establishments.

On February 6, the Ministry of Foreign Affairs (SRE) reported that it prepares the strategy that its legal team in the United States will continue in the two judgments that it has open against manufacturers and sellers of firearms in that country.

In a statement, the agency reported that the legal consultant, Pablo Rocha, held a working meeting with the president of Global Action Against Gun Violence, Jonathan Lowy, and the lawyer Steve Shadowen, legal representatives of Mexico before the EU Courts.

Rrocha supervised the preparation of the hearing that will be held on March 4 at the Supreme Court of US, as part of the lawsuit filed by the Government of Mexico before a Federal Court of Massachusetts.

“The highest American court will analyze whether the companies demanded enjoy immunity, even if their practices facilitate the illicit traffic of weapons towards our territory,” said the Foreign Ministry.

“Likewise, the team discussed the strategy to follow in the litigation in Arizona, which has favorably advanced for Mexico to a new stage to gather evidence”

Recently, the Foreign Ministry, the Alcohol, Tobacco, Firearms and Explosives of the US (ATF) added that it estimates that around 200,000 weapons from that country are illegally trafficked annually.

“This is led by negligent commercial practices of manufacturers and vendors, who trade their products even when they are aware that they will end up in the hands of organized crime,” he said.

“The Government of Mexico will continue to strengthen its comprehensive strategy in the fight against illicit arms, exploring all legal roads at its disposal in the national, regional and global planes, to reduce the flows of these products that generate violence in our country” .
