The Federal Court of Appeals of the District of Columbia, in the United States, has rejected the President Donald Trump’s government request to allow the dismissal of the governor of the Federal Reserve (Fed) Lisa Cookwhich accuses of mortgage fraud, before the meeting this week of the Federal Open Market Committee (FOMC), responsible for setting interest rates.
“Given these unique circumstances and the great probability that Cook will succeed, at least, in its demand for due process, the government protection application is rightly denied,” said the American circuit judge Brad Garcia in the decision of the court, despite the disagreement of the only one of the three magistrates designated by Trump, Gregory Katsasaccording to the American news portal The Hill.
In this way, Cook will participate in the next vote of the Fed on the Interest ratesafter a judge ruled last week that his dismissal was probably illegal and reincorporated the court while the legal battle continues.
Trump fired the governor at the end of last month following a criminal complaint that claims that falsely declared properties in Michigan and Georgia as main residences with just weeks apart from each other in 2021, and that unduly presented a third property as its “second residence.”
The president has long criticized the Federal Reserve For not lowering interest rates more quickly, and Cook’s dismissal marks the president’s last attempt to fire an independent agency leader who, according to the Federal Law, cannot be fired without just cause.
The decision comes after last Wednesday a federal judge temporarily block Cook’s dismissal, claiming that the Trump administration accusation does not constitute a justified cause for its dismissal under the Federal Reserve Lawand considering that the way he was fired was to violate his constitutional procedural rights.
