Unanimous rejection of the ‘Cerrón Law’ that seeks control over judges and prosecutors

The president of the Congress, Eduardo Salhuanaspoke out on the bill presented by the congressman Waldemar Cerronbrother of the fugitive owner of Peru Libre. The initiative contemplates setting up a commission in Parliament to oversee judges and prosecutors.

When approached by the media, Salhuana said that he does not support the Perulibrist initiative.

“I personally do not share that point of view. He has the right as a congressman, but as a parliamentarian I do not share the same opinion, I do not support these initiatives,” he said.

The head of Parliament also indicated that the initiative must go through the relevant committees and collect the points of view of other parties. However, the press reminded him that the Justice Commission is chaired by Isaac Mita, a congressman from Peru Libre.

In response, Salhuana pointed out that although he may chair the commission, he does not necessarily decide on the initiatives.

“They preside over it but they do not decide. What we must ask of the parliamentary groups is that they be responsible, attend the meetings and that when voting, they reflect on the impact that it may have on the national justice system,” he said.

On the other hand, he pointed out that although he shares the Board of Directors with Waldemar Cerrón, that does not mean that he shares his proposals.

Judiciary rejects proposal

The president of the Judiciary, Javier Arevalosaid in Huánuco that the proposal of legislator Waldemar Cerrón “is contrary to the Constitution that guarantees judicial independence and is a law that has a totalitarian stench.” In that sense, he pointed out that it is an interference by Congress in another power of the State.

“It would imply that a power like Congress would interfere with the judges. Furthermore, with all due respect, there are people who are involved in investigations. And it would be contradictory if these people could supervise the judges,” he said.

The head of the Judiciary also indicated that the National Justice Board is responsible for overseeing judges and prosecutors.

“We are also audited by the Office of the Comptroller General of the Republic. In addition, we believe that the oversight that Congress would carry out would be of a political nature,” he said.

Arévalo said that he was attending a congress of judges in the city of Huánuco and indicated that everyone agreed that the bill should be shelved. In this regard, he said that parliamentarians with a “democratic vocation cannot accept that one branch of the State impose itself on another.”

Ministry of Justice: “It affects the democratic system”

He Ministry of Justice issued a statement rejecting the legislative initiative of Free Peru“It is incompatible with our Constitution, as it affects the principle of separation of powers,” he said.

The statement also states that “establishing political control over judicial and fiscal decisions contravenes the independence and autonomy of the organs of the justice system because it would allow interference in jurisdictional actions, which must be excluded from any influence and protected from any undue pressure.”

On the other hand, he indicates that citizens’ concerns regarding the deficiencies in the judicial system “are already resolved by our own constitutional design.” In this regard, he indicates that the Comptroller’s Office, the JNJ and the national control authorities are in charge of supervising magistrates.
