The Constitutional Chamber of the Supreme Court of Justice admitted an appeal against the viral challenges promoted by TikTok in Venezuela that has caused the death of two teenagers and disturbances in at least 300 young people who inhaled toxic gases.
The decision of the highest court of Venezuela is contained in ruling number 0958 written by Judge Tania D’Amelio, announced this Thursday night. There it is explained that they agreed to redirect the constitutional protection action filed by Yuleidi Carrizo Rivas, representing the Bolivarian Family Movement ‘Aristóbulo Istúriz’. And instead of studying it as an appeal for protection, the magistrates analyzed it as a demand for diffuse or collective rights or interests, since the protection of society in general from the viral challenges of TikTok is requested.
For this reason, the Chamber declared itself competent to hear said claim and admitted it. And due to the urgency and the interests affected, a hearing was called for this Thursday at 11 am to hear the parties.
Those summoned are specifically mentioned in the ruling and refers to the Attorney General of the Republic, the Ministry of Education, the President of the Autonomous Institute National Council for the Rights of Children and Adolescents (Idenna) and the Ministry of Health.
Likewise, the Court ordered the summons of the interested parties by means of a poster, which will be published by the plaintiff in one of the newspapers with the greatest national circulation.
Last Wednesday, the spokespersons for the Bolivarian Family Movement went to the TSJ to file an appeal for protection that seeks to “protect the rights of minors who may be victims of the content promoted on digital platforms.”
