The Supreme Court of Justice (TSJ) is attentive to any situation that undermines the practice of law, as can be seen from ruling 527 of the Constitutional Chamber.
The aforementioned sentence, published on April 10, came into force in recent days, due to a series of alleged arrest warrants processed from the Prosecutor’s Office 26 of Anzoátegui in charge of Kleyvis Hernández, according to testimonies. In this regard, the aforementioned TSJ ruling dedicates three paragraphs to the defense of the lawyer’s work. “It cannot be said that the defender in a criminal case is an accomplice or is associated with his client to commit a crime, nor that the attorney in a civil case is a partner and co-responsible with his client for the results of the process. To affirm otherwise would be to criminalize the lawyer’s profession and simultaneously subject to criminal jurisdiction the same facts that, because that procedural avenue has been exhausted, must be heard before the civil courts, which are the only ones competent to hear this case. The Constitutional Chamber recalled that it is the guardian and guarantor “of existing positive law and protection of the human rights of individuals.” And for this reason “it remains alert to any situation that could undermine this constitutional guarantee of such vital importance.”
