TSJ urged the Public Ministry to restart the extradition of alias Satan

They will try a woman requested in France for pimping

The Criminal Chamber of the Supreme Court of Justice annulled the process to bring to Venezuela via extradition a member of the Tren de Aragua criminal organization and urged the Public Ministry to rework such a request, correcting the “vices” detected in the original processing. Such decision is contained in judgment No. 209, written by Judge Elsa Gómez.

The subject that Venezuela wants to judge here in the national courts is identified as Hernán David Landaeta Garlotti, alias Satan, a member of the Aragua Train who migrated and settled between Peru and Chile where he founded a criminal cell, according to investigations.

He is considered one of the main assassins of the aforementioned organization recently identified by the attorney general, Tarek William Saab as the material author of the murder of sociologist Carlos Lanz.

But the events for which alias Satan is to be tried in Venezuela occurred on April 13, 2015 in the La Ovallera sector, Libertador municipality (Palo Negro), Aragua. There, alias Satan, along with other members of the Aragua Train, murdered William Roberto González Martínez with various firearms.

Satan fled Venezuela and was captured in Lima, Peru on February 18, 2019. As a result, Oscaily Del Valle Nuñez Montoya, 32nd Prosecutor of the Public Ministry of Aragua, filed on April 5 of this year before the Court 2 ° of Control of Aragua the process to start the extradition process of Landaeta Garlotti.

This is precisely one of the “vices” detected by the Criminal Chamber in the process, since Prosecutor Nuñez Montoya did not offer “a reasonable explanation that justifies the three-year delay in filing the active extradition request, which evidently translates to unjustified delay”.

In addition, the Prosecutor did not specify whether the subject is detained in Chile or Peru, the magistrates claim.

For this and other reasons, the Criminal Chamber ex officio annulled the extradition request and urged the Prosecutor’s Office to restart the process against alias Satan “regardless of the vices found here.”

The magistrates also asked the General Inspectorate of Courts to open a file on the 2nd control judge of Aragua Blanca Yoselin Guaicara Galea for failing to observe the legal norms that regulate the extradition procedure.
